1. General
In these general terms and conditions the following terms shall have the following meanings: a. Patient: the person who has instructed IJsselDental to perform dental work (treatments). b. Treatment: all treatments as recorded in a budget or invoice sent to the patient in advance and all actions directly related to the (verbal) order of the patient in the broadest sense of the word.
2. Applicability
2.1 These conditions serve to clarify for the patient the content of the conditions that apply to the execution of the order between him/her and IJssel Dental and apply to every offer and every agreement between the patient and IJssel Dental to which IJssel Dental has declared these conditions applicable. If the parties deviate from these conditions, this must be recorded in writing.
2.2 The general terms and conditions form an integral part of the dental treatment agreement(s) between the dentist, including his employees, and the patient. They are made available to the patient or his legal representative(s), are present in the waiting room or are sent upon request.
2.3 The agreement is in principle concluded at the moment that the patient agrees to the treatment. This can be done either verbally or in writing.
3. Confidentiality and Protection of Personal Data
3.1 IJssel Dental is obliged to maintain confidentiality towards third parties who are not involved in the execution of the assignment. This confidentiality obligation concerns all information of a confidential nature that has been made available to IJssel Dental by the patient, unless disclosure of certain data is required by law.
3.2 IJssel Dental is entitled to share information obtained, including personal data, images, results and/or models, with third parties such as colleagues, dental technicians, health insurers and government agencies. The data may also be used anonymously for research, publications, accreditations, presentations, own website and patient information, without the information being traceable to the individual patient.
4. Third parties
The dentist is entitled to engage third parties in the performance of the agreement. He will exercise care in selecting these third parties and, if reasonably possible, consult with the patient in advance. The dentist is not liable for the actions of these third parties.

5. Force Majeure
5.1 Circumstances that prevent the execution of the order and that cannot be attributed to IJssel Dental, such as strikes, staff shortages and other unforeseen problems, are considered force majeure.
5.2 In the event of force majeure, IJssel Dental's obligations will be suspended. If the period of force majeure lasts longer than three months, both parties have the right to terminate the agreement, without any obligation to pay damages.
6. Appointments, Cancellation and SMS service
Appointments must be cancelled free of charge at least 48 hours in advance. Appointments that are not kept or cancelled less than 48 hours in advance will incur a charge.
7. Costs and Payments
7.1 The costs of treatment, including materials, will be charged to the patient, regardless of whether the patient can declare the costs with a health insurer. Payment must be made within 30 days after the invoice date.
7.2 IJssel Dental uses factoring company Infomedics to process payments.
8. Treatment and Information
Before each extensive dental treatment, the patient is informed in writing about the estimated costs. In case of changes in the treatment plan or unforeseen complications, the patient is informed about this.
9. Liability
The liability of IJssel Dental is limited to the amount covered by the professional liability insurance taken out by IJssel Dental, plus the amount of the deductible.
10. Warranty conditions
10.1 A warranty period of 1 year applies to fillings.
10.2 Root canal treatments, implants, orthodontics, crown and bridge work, periodontitis treatments and prostheses are not covered by the warranty, because the results depend on the body's own factors.
10.3 In the event of full replacement under warranty, this falls under the original warranty period.
11. Complaints and Disputes
Complaints about the service can be submitted in writing to [info@ijssledental.nl]. If we cannot resolve the matter together, the patient can contact the KNMT Complaints Service to initiate complaint mediation.
